General conditions
Application
The underlying General Terms and Conditions outline the framework for the commercial relations that could arise between a customer and the company BierenVanBegeerte, hereinafter referred to as 'BVG'.
Acceptance
The use of the website www.bierenvanbegeerte.be, as well as placing an order with BVG, implies that the customer unconditionally and irrevocably accepts the underlying General Terms and Conditions. BVG is a sole proprietorship, established in accordance with Belgian law and established in Belgium, more specifically at Marie-Josélaan 51 in Berchem. BVG is registered in the trade register under number 347 921 with enterprise code BE (0) 769 235 239.
Definitions
1. Services: all services offered by BVG in general, the sale of goods and services via the internet in particular.
2. Client: any person who enters into a commercial relationship with BVG by purchasing a product or a service. A client is deemed to be authorised to make this purchase and to be authorised to conclude a commercial transaction with BVG.
3. Order: any order placed by a client in accordance with the conditions as described in these General Terms and Conditions.
Order
The products and services are offered for sale via the website www.bierenvanbegeerte.be. Regardless of any written proof the client may have, it is explicitly agreed that only the data recorded in the computer system of BVG, its hosting partner or its payment partner constitute proof of the communication, the content of the order and the whole of the transaction(s) that have taken place between the parties. The customer will receive a confirmation of the order by e-mail after the purchase and a second e-mail when the order is sent by BVG.
Prices and payment methods
The prices quoted during the purchase process are in Euros (€) and include VAT and administrative costs unless explicitly stated otherwise. The prices of the products and services do not include transport costs. These will be charged separately if you choose to ship.
BVG reserves the right to change the sales prices at any time. However, the purchased products and services will always be invoiced at the prices mentioned in the e-mail confirming the order. These are the prices applicable at the time of purchase. The products remain the property of BVG until they have been paid for in full by the client. BVG reserves the right to refuse any order from a client with whom a dispute is pending or has arisen in the past. The ordered products can be paid for online or transferred immediately. The customer's bank account will be debited after confirmation of the purchase, and payment will only become effective once the customer's bank has given its consent to BVG.
In case the customer's bank refuses payment, the order will also be automatically refused. The customers guarantee that they are legitimate to make online payments and that there is sufficient cover on the bank account to cover all costs arising from the transaction. Entering the confidential payment details on the BVG website is secure. BVG has no access to the confidential payment data of its clients. These are therefore not stored at or by BVG. This is the reason why we request the payment details again with every purchase.
Availability
The products and services, as well as the prices are valid as they appear on the BVG website. BVG undertakes to do its utmost to deliver all orders. Nevertheless, BVG cannot be held responsible for the unavailability of a product or service, nor for the damage that could result from this in case of force majeure. If one or more products or services of an order are not available, or are not available on time, the client will be informed by e-mail or telephone that his or her order will be cancelled or postponed in whole or in part. In case the unavailability is determined and communicated at the moment the customer has already paid for his products, BVG will immediately ask its bank to refund the amounts paid. In the event that the unavailability is established and communicated at a time when the customer has already paid for their products, BVG will immediately ask its bank to refund the amounts paid. The customer will be notified of this by email.
Delivery
Orders will be delivered to the address provided by the customer during the ordering process and in accordance with the terms and conditions described therein. Delivery will be offered to the customer or to any other person present at the specified address. If no one is available to receive the parcel when it is delivered, the carrier will leave a note in the letterbox with the name and contact details of the carrier. The customer must contact the carrier themselves to arrange where and when the parcel can be collected. BVG ensures that the order is processed as quickly as possible. The delivery period of 7 days after the end of the online sale is a target period and is purely indicative. BVG cannot under any circumstances be held responsible for any delay in the delivery of the products or services, nor for any damage that may result from this. The control system used by the carrier serves as proof of the effective delivery of the order and of its proper receipt, unless the customer can prove otherwise. In the event that a customer proves that a delivery was not made within 30 days of the order date, the customer may cancel the order without penalty by registered letter addressed to BVG.
In the event that a delivery is lost during the delivery process, BVG will send a new shipment at its own expense if the product is still available, or refund the amount of the order, including transport costs.
Non-conformity
All products and services offered for sale on the BVG website are described in good faith and as accurately as possible. Nevertheless, the photographs shown on the website have no contractual significance. BVG accepts no responsibility for any errors that may occur in the descriptions of the products or services or in the photographs. On the other hand, BVG undertakes to correct any errors reported to it as quickly as possible. If the product or service delivered does not correspond to the order, the customer may return the product or service within 14 calendar days of receipt. Once these 14 days have passed, complaints and returns will no longer be accepted.
Right of withdrawal, returns and refunds
In accordance with the Belgian law of 14 July 1991 on commercial practices and the protection of customer privacy, and the amendment to this law of 25 May 1999, the customer has the right to inform the seller within 14 calendar days of receiving the product that they wish to withdraw from the purchase without having to pay compensation and without having to give a reason. inform the seller that they wish to cancel the purchase without having to pay compensation and without having to give a reason. The right of withdrawal is, of course, only valid if the product is actually returned within 7 working days after the customer has informed BVG that they wish to cancel the purchase. Once the 7 working days have elapsed, BVG will no longer be able to accept the return, and it will be sent back to the sender. The customer must pay the shipping costs for the return themselves. The refund will be made within 30 days of receipt of the return by BVG, provided that all the conditions described above are strictly met. In any case, the amount refunded will never exceed the amount actually paid by the customer. BVG will send an email when it has received the return and when it has asked its bank to make a refund. The right of withdrawal can also be exercised after the purchase has been made, but before the order has been shipped. In that case, the refund will be made within 30 days of receipt of the order cancellation.
Responsibility
BVG accepts no responsibility whatsoever for the content of third-party websites, in particular about compliance with privacy and personal data protection, to which BVG has provided a link on its website. BVG cannot be held responsible for any errors in the photographs or texts used for the product descriptions on the BVG website. BVG cannot be held responsible for the inability to deliver orders, including cases of force majeure, disruption or strike of transport, postal or communication services, in the event of flooding or fire. In all cases where BVG's responsibility is invoked, BVG's responsibility is limited to the amount actually paid by the customer for an order.
Intellectual property rights
All texts, photographs, drawings, graphics, images, sounds, data, databases, software, names, trade and domain names and all other components of the website are copyright-protected works. The BVG website itself is also protected by copyright. None of these components, nor the website itself, nor the information offered on the website may therefore be stored (other than as necessary to view the website), reproduced, modified, published, distributed, transmitted, sold, transferred to third parties or used in any way unless BVG has given its prior written consent. Unless otherwise agreed in a contract, by sending digital data to BVG, every legal entity or natural person transfers all its property rights, including intellectual property rights, to the aforementioned data to BVG.
Disputes and applicable law
Any dispute relating to the use of the website and to the underlying General Terms and Conditions is subject to Belgian law. In the event of a dispute, the courts of Antwerp shall have exclusive jurisdiction.
Changes to the general terms and conditions
BVG may change the underlying General Terms and Conditions at any time. Any use of the BVG website implies that you have read and accepted the General Terms and Conditions. BVG reserves the right to change the design and content of its website at any time.
